- GiftMate voucher (voucher) is a value voucher which will entitle a purchaser or recipient thereof (customer) to buy products/ avail services of matching value at PayMate accredited merchants. Customers can check www.giftmate.co.in for details of PayMate merchants where the voucher is redeemable. PayMate accredited merchants can be online/retail stores. GiftMate voucher can be used for making payment of essential & non-essential services followed by the vouchers shall be issued subject to compliance of KYC requirements as prescribed by RBI from time to time.
- The maximum value of a voucher is Rs. 10,000 for payment towards utility bills & essential services and Rs. 5,000 in other cases after submitting requisite KYC documents.
- Vouchers can be issued to any valid Indian mobile number or email address and is usable at all accredited PayMate merchants. Only persons at least 18 years of age shall be entitled to purchase/receive and/or redeem a voucher.
- The voucher is a mobile/ email gift voucher. For utilizing the voucher, a customer will have to look for PayMate at the participating merchants, enter their mobile number/ credit card number and authenticate the transaction with their GiftMate PIN number either through SMS or an IVR call on their mobile or a message to their email address or through any other method set out by PayMate from time to time.
- Vouchers will be valid for a period of one year from the date of issue or as otherwise mentioned. Credit will not be given for unutilized and unclaimed vouchers and the vouchers cannot be encashed. There shall be no voucher extensions. PayMate will not be responsible for product deliveries / quality of product and or service at participating merchants.

- Customers are responsible for remembering their PIN and ensuring that transactions are authenticated by them and PayMate will not be responsible/ liable for any misuse of the voucher and/or incorrect or inadvertent disclosure of the PIN by them and consequent redemption of the voucher.
- These terms and conditions as accepted by customer shall be read along with and in addition to any terms and conditions in force from time to time and issued by any online merchant or retail store.
- After the registration, and to enable the customer to use the mobile payment, a Personal Identification Number (PIN) will be communicated to the customer on his mobile phone (mobile) or email address in the first instance. This PIN may subsequently, be changed by the customer through his mobile/ GiftMate Account. The PIN provides access to the PayMate system and the customer irrevocably and unconditionally accepts the sole responsibility for use, confidentiality and protection of the PIN, as well as for all orders and information changes entered into the mobile/ e mail/GiftMate account using such PIN. The customer shall delete PIN stored in mobile/ e mail and shall not keep any record of the PIN in a form so as to facilitate the PIN coming to the knowledge of a third party. PayMate is authorised by the customer for carrying out transactions and instructions authenticated by the PIN and the customer shall not revoke the same.
- PayMate has no obligation to verify the authenticity of the transaction instruction sent or purported to have been sent from the customer other than by means of verification of the customer’s PIN. The customer shall at all times take all appropriate steps, including those as mentioned herein, to maintain the security of the PIN. If the customer fails to observe the security requirements, he may incur liability for PayMate. PayMate may, in its absolute discretion, issue a new PIN to the existing customer.
- Subject to the provisions stated herein and as specified by PayMate from time to time, the customer will not hold PayMate liable in case of any improper/ fraudulent/unauthorized/ duplicate/erroneous use of the mobile and/or the PIN. PayMate will also not be liable for any consequences connected with the use/ misuse of the mobile/ e mail account by any third party. If any third parties gain access to the services, the customer will be responsible and shall indemnify PayMate against any liability, costs or damages arising out of such misuse / use by third parties based upon or relating to such access and use, or otherwise.
- The customer agrees that the PayMate service shall not be used for payment for any illegal/unlawful/ banned purchases/ purposes. PayMate's record of the amount of any charge, specified herein above, shall, in the absence of manifest error, be final and binding on the customer, and shall be conclusive in any case where PayMate has effected any payment pursuant to a mobile/ email payment.
- If a mobile is lost or stolen, the customer must deactivate the mobile / SIM card from its service provider of mobile services. In the event that PayMate determines that the customer has failed to take the steps as mentioned above in case of loss / theft / destruction of the mobile and the same are questionable, financial liability on the lost, stolen or damaged mobile would rest with the customer.
- The customer shall not reveal his PIN to anyone else nor use someone else’s PIN. The customer shall be fully responsible for maintaining the confidentiality of his PIN password and agrees to notify PayMate of any unauthorized use of his PIN or any other breach of security.
- The customer shall be fully liable for: (a) any unauthorised use of the mobile; and/or (b) all authorised transactions on the mobile.
- Without prejudice to the remedies available to PayMate and these Terms, PayMate shall be under no liability whatsoever to the customer in respect of any loss or damage arising directly or indirectly out of:
- any defect in any goods or services supplied;
- any inability of a merchant to supply or deliver the required products or services in the necessary numbers or types;
- the refusal of any person/merchant to honour or accept a mobile/ e mail payment;
- the malfunction of any computer terminal or equipment;
- the giving of transaction instruction by any person other than by a customer;
- handing over of the mobile by the customer to anybody or the accessing of a customer’s e mail account by some other party;
- any injury to the credit, character and reputation of the Customer alleged to have been caused by the repossession of the mobile and/or, any request for its return or the refusal of any merchant to honour or accept the mobile payment;
- any mis-statement, misrepresentation, error or omission in any details disclosed by PayMate - Not withstanding this, the customer shall indemnify PayMate against any loss, damages or injuries, liabilities, actions, suits proceedings, claims, demands made against PayMate by any customer for any reason whatsoever arising out of the use of the PayMate service.
- Confirmation on the mobile/ email address of the customer together with the transaction ID noted thereon shall be conclusive evidence of the liability incurred by the customer using the PIN and will be conclusive proof of the customer effecting the transaction. PayMate shall not be required to ensure that the customer has duly received the purchased goods or services. In the event the customer chooses to disagree with a charge, the same should be communicated to PayMate within 15 (Fifteen) days of transaction.
- The customer shall comply with all such terms and conditions as PayMate or its associates may prescribe from time to time for facilities/ services availed of by the customer. All such transactions effected by or through facilities for conducting transactions, established by or on behalf of PayMate or its affiliates, for and in respect of such facilities/ services offered, shall constitute legally binding and valid transactions when done in adherence to and in compliance with the terms and conditions prescribed by PayMate or its associates for such facilities/ services, as may be prescribed from time to time.
- The customer shall be subject to and bound by any terms, directions or policies that may be issued from time to time by Reserve Bank of India or any Government authority, with regard to such vouchers.
- The mobile/ email payment shall be accepted by any merchant whose name appears in the list of accredited merchants listed on the PayMate website. The reimbursement to the merchants by PayMate will constitute a valid discharge of the customers obligation to pay directly to the merchant, which supplied goods or services to the customers.
- PayMate will charge all statutory taxes, service tax, all other imposts, duties (including stamp duty and relevant registration charges, if any, in connection with the mobile) and taxes (of any description whatsoever) as may be levied from time to time by the Government or other authority in respect of the service charges or in connection with the mobile payment.
- Unless otherwise set out, all payments and currency references are in Indian Rupees. PayMate may, if required by law, change any fee or charge or institute new fees or charges. The customer agrees to pay all fees and charges so levied.
- PayMate shall not make any refunds of any amounts whatsoever nor shall Paymate redeem or renew any vouchers.
- Vouchers cannot be resold by any person other than a duly authorised Reseller appointed by PayMate.
- PayMate reserves the right to vary any of the terms and conditions contained herein by posting the revised terms on PayMate’s website without notice to the customer.
- The Customer hereby accepts that he may, from time to time, receive from either Paymate or its associates, communications such as service announcements, advertisements or administrative communications.
- All information provided by the customer to Paymate shall be accurate, current and complete.
- PayMate shall not be liable for any direct, indirect, punitive, incidental, special or consequential damages or any damages whatsoever arising out of or in any way connected with the services provided by PayMate, including, but not limited to, any delay or inability to use the PayMate site or services or otherwise.
- PayMate makes no representation or warranty about the quality, suitability, reliability, availability, merchantability, delivery, lack of viruses or other harmful components or accuracy of information relating to the products or services sought to be purchased by the customer.
- Any link on the PayMate website to a third party site is not an endorsement of that website. The use or browsing by a customer of any other website shall be subject to the terms and conditions in each such website.
- PayMate does not endorse any advertiser or merchant linked to its website. The customer must verify all information provided by the merchants/ advertisers before arriving at his decision to purchase any product.
- The customer’s participation in any event/ contest/ promotion shall be governed by the terms and conditions mentioned in the respective event/ contest/ promotion along with these terms.
- PayMate shall not be liable for any unauthorised access to the customer’s data or any unauthorized transmissions sent through the PayMate service.
- Paymate shall have the right, at its sole discretion, to:
- restrict or terminate a customer’s access to its services;
- modify or discontinue its services or any part thereof;
- require a customer to provide details in respect of voucher purchased, used and any other details as required by PayMate from time to time without incurring any liability therefor. In certain situations, if a customer’s mobile number/ email address is blocked by PayMate due to any reason whatsoever, a voucher may be issued to the customer on the receipt of alternate details. - Neither party shall be liable for any breach of this agreement caused by any force-majeure event such as act of god, fire, lightning, explosion, flood, inclement weather conditions, power failures, equipment breakdown, strikes, lock-out or any other cause beyond the control of either party. If a customer violates any of these terms and conditions, PayMate reserves the right to deactivate all such user registrations and cancel any or all GiftMate voucher balance without any notice or refund.
- If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
- PayMate may assign or transfer rights & obligations under this agreement.
- Incase of any dispute between the parties on the interpretation or implementation of this agreement, the appropriate court in Mumbai shall have exclusive jurisdiction.
